3DPrinterOS Services (with its affiliates, “3DPrinterOS”, “we” or “us”) TERMS OF SERVICE (“Terms”) govern your access to and use of our websites, software and services (“Services”) so please read carefully them before using the Services. 3DPrinterOS Services Terms and Privacy Policy are effective as of June 30, 2013.
By using the Services you agree to be bound by these Terms. If you use the Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms. In that case, “you” and “your” will refer to that organization. If you do not agree to these Terms, do not use the Services.
You may use the Services, including the websites and the materials incorporated in the websites solely for your non-commercial, personal use only. No part of the website, including any materials incorporated therein, may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, service, website or other medium for publication or distribution or for any commercial enterprise, without 3DPrinterOS’s express prior written consent. Reproducing content from the Services and from our websites for normal editorial purposes such as writing articles on editorial websites is allowed if done with honest intentions and in good taste.
THE AGREEMENT.
Your use of 3DPrinterOS services is governed by these Terms of Service, our Privacy Policy, any applicable country specific terms, and the terms of your Order or individual services. Your order may have additional terms that apply to the particular services in your order. When using the term “Agreement” in any of the order, 3DPrinterOS services, privacy policy or other terms we are referring collectively to all of them, including any product specific terms that apply to the Services. READ THIS AGREEMENT CAREFULLY.
Your Files & Your Privacy
By using our Services you provide us with information and files that you submit to 3DPrinterOS (“files”). You retain full ownership to your files. We do not claim any ownership to any of it. These Terms do not grant us any rights to your files or intellectual property. Some limitations may apply to run the Services and these are explained below
We may need your permission to perform certain operations with your files, such as hosting your files or sharing them at your direction. This includes product features visible to you, for example, file thumbnails or previews. It includes technical administration of our Services, for example, how we backup data to keep it safe. You give us the permissions we need to perform those things solely to provide the Services. This permission applies also to trusted third parties we work with to provide the Services, for example, storage providers to provide the Services.
3DPrinterOS does not share your content with others, for any purpose including law enforcement, unless you direct us to. In our Privacy Policy below we explain how we collect and use your information generally.
You are solely responsible for your conduct, the content of your files and your communications with others while using the Services, including sharing of your files. It is your responsibility to ensure you have the rights or permission necessary to comply with these Terms.
You acknowledge that 3DPrinterOS has no obligation to monitor any information on the Services. We are not responsible for the functionality, printability, quality, accuracy or legality of files or any other information you share or may be able to access using the Services.
Sharing your Files
Our Services have features that allow you to share your files with others. These features include, for example, printer and file sharing, monitoring of your printer and file activity, also by others if you allow it. Please consider carefully with whom you share printers and files. 3DPrinterOS has no responsibility of your choices and activity. 3DPrinterOS assumes no responsibility for the quality of any of the uploaded files.
When you upload files (g-codes or stl files) to Services, we may analyze the files to be able to display the correct printing requirements and settings to you and to the file recipient as specified by the creator of the file. These settings help you and the recipient to determine that the destination printer is, in principle and technically, able to print the file. If you are the recipient of a file, you must read the shown settings, verify their suitability for the intended printer and accept the Terms before initiating printing. The settings may or may not be accurate and must not used as the sole method of verifying that the file is printable by the intended printer. 3DPrinterOS assumes no responsibility whatsoever for the accuracy of the analyzed and displayed settings and provides this feature “as is” without any guarantees of quality, accuracy or reliability.
Storing your Files
You acknowledge that the Services are primarily a 3D printing, sharing and collaboration service. The Services are not to be used as your sole data storage or backup service. You are, for example, not able to download stored Files from Services, only delete or update Files. This is for improving the security and privacy of your Files. You acknowledge that you must keep other copies of your Files stored elsewhere, outside of the Services, locally or in other services. 3DPrinterOS does not print or use your Files for other purposes than those directed by you.
Legal Responsibilities
Files and other content in the Services may be protected by intellectual property rights of others. Please do not copy, upload, download, or share files unless you have the right to do so. You, not 3DPrinterOS, will be fully responsible and liable for what you upload, copy, share, stream, print or otherwise use while using the Services. You must not upload spyware or any other malicious software to the Service.
You, and not 3DPrinterOS, are responsible for maintaining and protecting all of your files. 3DPrinterOS will not be liable for any loss or corruption of your files, or for any costs or expenses associated with backing up or restoring any of your files.
If your contact information, or other information related to your account, changes, you must notify us promptly and keep your information current. The Services are not intended for use by you if you are under 13 years of age. By agreeing to these Terms, you are representing to us that you are over 13.
DISCLAIMER ABOUT SENDING PRINT JOBS TO REMOTE 3D PRINTERS
3DPrinterOS assumes no liabilities or responsibilities arising from remote 3D printing on manned or unmanned, attended or unattended 3D printers using the Services. Printing on unattended printers, whether your own or a 3D printer shared to you, happens at your own risk. There may be technical malfunctions in the destination 3D printer that can lead to unsuccessful prints or damages to the 3D printer. This includes but is not limited to unsuccessful prints, bad quality prints, damages to the 3D printer (e.g. from initiating a new print job on a 3D printer that has a previous print job still on the print tray). If there is a remote visual observation feature (e.g. web camera) available in the Services for remote visual observation of ongoing printing, we strongly recommend using such connection and feature. Such feature is not a guarantee of quality or successful printing and may malfunction or be unreliable. Do not use such feature as a sole method of verifying that a 3D printer is functional, operational and available. Such feature is provided “as is” without any guarantee of continuous service, reliability or quality.
Account Security
You are responsible for safeguarding the password that you use to access the Services and you agree not to disclose your password to any third party. You are responsible for any activity using your account, whether or not you authorized that activity. You must immediately notify us of any unauthorized use of your account.
Software and Updates
Some use of our Service requires you to download a client software package (“Software”). 3DPrinterOS hereby grants you a limited, nonexclusive, nontransferable, revocable license to use the Software, solely to access the Services. Your license to use the Software is automatically revoked if you violate these Terms in a manner that implicates our intellectual property rights. We hereby reserve all rights not expressly granted in these Terms. You must not reverse engineer or decompile the Software, nor attempt to do so, nor assist anyone else to do so. Our Services may update the Software on your device automatically when a new version is available.
3DPrinterOS Property and Feedback
These terms do not grant you any right, title, or interest in the Services, Software, or the content in the Services. When giving us feedback, please be aware that we may use any feedback, comments, or suggestions you send us or post in our forums without any obligation to you. The Software and other technology we use to provide the Services are protected by copyright, trademark, and other laws of Estonia, Finland, and European Union as a whole, and other countries. These Terms do not grant you any rights to use the 3DPrinterOS trademarks, logos, domain names, or other brand features.
3DPrinterOS asks you to respect the intellectual property of others. If we are notified of legally enforceable copyright infringements we will comply. Such notices can be reported to us using any of the contact channels given on our web pages. We reserve the right to delete or disable content alleged to be infringing and to terminate repeated infringers.
Other Content
The Services may contain links to third-party websites or resources. 3DPrinterOS does not endorse and is not responsible or liable for their availability, accuracy, the related content, products, or services. You are solely responsible for your use of any such websites or resources. Also, if we provide you with any software under an open source license, there may be provisions in those licenses that expressly conflict with these Terms, in which case the open source provisions will apply.
Termination
You are free to stop using our Services any time. We reserve the rigth to suspend or end the Services at any time, with or without cause, and with or without notice. For example, we may suspend or terminate your use if you are not complying with these Terms, or use the Services in any way that would cause us legal liability or disrupt others’ use of the Services. If we suspend or terminate your use, we will try to let you know in advance. In cases of repeated or flagrant violation of these Terms, a court order, or danger to other users or their property, we may suspedn immediately.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
3DPrinterOS is Available “AS-IS”
THE SERVICES AND SOFTWARE ARE PROVIDED “AS IS”, AT YOUR OWN RISK, WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 3DPrinterOS will have no responsibility for any harm to your computer system, loss or corruption of data, or other harm that results from your access to or use of the Services or Software. Some states or countries do not allow the types of disclaimers in this paragraph, so they may not apply to you.
YOUR INSTALLATION, USE AND ACCESS OF THE SERVICES IS AT YOUR SOLE DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGES TO YOUR DEVICE, SOFTWARE AND THE LOSS OF YOUR USER DATA THAT RESULTS FROM THE USE THEREOF. DEPENDING ON THE SERVICES YOU CHOOSE TO UTILIZE, YOUR USER DATA MAY NOT BE AVAILABLE OR RESTORABLE IF (1) 3DPrinterOS HAS NOT COMPLETED COPYING OR SYNCING YOUR USER DATA, (2) FOR FILES, FOLDERS OR DISK DRIVES THAT THE SERVICES DO NOT AUTOMATICALLY BACKUP OR SYNC, YOU DO NOT MANUALLY SELECT THEM FOR BACKUP OR SYNCING OR YOU UNSELECT CERTAIN USER DATA FOR BACKUP OR SYNCING, (3) 3DPrinterOS SERVERS OR NETWORK SERVICE IS UNABLE TO MAKE A CONNECTION WITH YOUR DEVICE, (4) YOU FAIL TO FOLLOW 3DPrinterOS’S TECHNICAL REQUIREMENTS, AND DOCUMENTATION FOR UTILIZING THE BACKUP SERVICES, INCLUDING UPGRADING THE VERSION OF THE SERVICES AS REQUIRED, AND PERIODICALLY TESTING YOUR BACKUPS AND RESTORES, OR (8) YOU TERMINATE YOUR LICENSE OR FAIL TO RENEW YOUR SUBSCRIPTION TO THE SERVICES.
Modifications
We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you (for example via email to the email address associated with your account). Other changes may be posted to our blog or terms page, so please check those pages regularly. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Services.
